Petitioner was arrested on the basis of a secret information to the effect that he is habitual of selling and supplying the narcotic drugs alongwith co-accused who was actually found in possession of the contraband on a motor cycle with registration mark PB-09-C-9748. 649 grams of heroin, three pistols and cartridges were recovered from the

possession of his co-accused. So far as petitioner is concerned, he is involved in the case being owner of the motor cycle.
Petitioner claims that he had already sold the motor cycle prior
to the date of recovery.
Since recoveries have already been effected; the petitioner was not arrested from the spot; has been involved in the case on the basis of ownership of the motor cycle and has been in custody w.e.f. October 8, 2013, the petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court.
