complainant. There is no dispute regarding the facts given by the learned counsel for the petitioners. It is clear from the FIR itself that the marriage took place on 6.8.2006 and she went back within one month to England in the first week of September 2006. It looks that there was no matrimonial dispute at that time that is why she sent sponsorship to her husband and called him to England, who went there on 23.7.2007. Otherwise also, as per the FIR, she came back in December 2006 and resided till February 2007, and till then no cruelty or harassment was given by the present petitioners, that is to say during the period from December 2006 to February 2007. After that, the complainant never resided in India with the present petitioners and the FIR has been got lodged after more than three years and four months. Otherwise also, a perusal of the record shows that no specific instances have been given regarding any harassment by the present petitioners. As per the facts, the complainant made complaint against her husband on 4.10.2007 and the husband came back on 9.10.2008 to India and never went back and resided with the complainant, who is NRI.
