It is nowhere pleaded in the contempt petition that the order dated 14.10.2014 (Annexure P,5) passed by this Court in Transfer Application No.600 of 2014 was ever placed before respondent No.1. It is only stated that on 14.10.2014 itself, during the course of hearing of the matter before respondent No.1, he was apprised of the fact that such an order is passed by this Court. However, on 14.10.2014 respondent No.1 adjourned the matter for final hearing on 24.12.2012, when it was disposed of.
In these circumstances, when there is no document to show that the order of this Court was ever placed on the file before respondent No.1, the provisions of the Contempt of Courts Act are not attracted.
Petition stands disposed of.
