Learned JMIC, Faridabad while appreciating the evidence vide judgment dated 14.08.2012 dismissed the complaint and acquitted accused. The findings of learned JMIC, Faridabad are correct while appreciating the evidence in right perspective. Nobody will give the loan of 13,50,000/-, even friendly loan without executing any document. Though the complainant states that it was a friendly loan and given for three months, even then, such a huge amount in this case in cash has been given without executing any document. Secondly, no date has been given as to when this amount has been given. Only it is written that in the month of June 2012, this amount has been given. There is neither evidence on the record to show as to whether this amount has been withdrawn from any bank nor capacity of the complainant has been proved to lend such a huge amount. There is nothing on the record to show from where this amount has come to the complainant. Thirdly, as per law discussed by the learned lower Court, the amount of more than 20,000/- cannot be paid in cash but only through cheque etc. Further, the accused produced three DWs including himself, who have deposed that car was got
