Petitioner-Mahesh has filed the present Regular First Appeal assailing the order dated 3.2.2011 passed by the learned Addl. District Judge, Palwal whereby his reference under Section 30 of the Land Acquisition Act, 1894 (for short “the Act”) claiming a portion of the compensation being an interested person for the acquired land measuring 8 kanals was dismissed by holding that it was respondent No.6-Rajrup Singh, who is entitled to receive the compensation qua the said land.
The main appeal stands adjourned to 3.12.2013 for service of the unserved respondents.
In the meanwhile, an application bearing C.M.No.12834-CI of 2013 has been moved by the appellant praying for permission to withdraw the present appeal.

At the time of hearing, learned counsel for the appellant makes an oral prayer for preponing the date of hearing from 3.12.2013, to which learned counsel for contesting respondent No.6 has no objection.

In view of the contents of the application bearing C.M.No.12834-CI of 2013, supported by an affidavit of the appellant, the same is allowed and the present appeal bearing RFA. No.6550 of 2012 is permitted to be dismissed as withdrawn .
