The question that arises for consideration in this appeal is whether the ad-hoc service rendered by respondents can be counted for the grant of step-up increments admissible on completion of a particular length of service? The ancillary question to be determined is whether the ad-hoc service/work charge service can be counted towards seniority and

We find that these questions have not been elaborately dealt with in the order under appeal. Similarly, a co-ordinate Bench in LPA No. 1385 of 2012 (State of Punjab and others) Vs. Baldev Singh and others, vide its order dated 20.11.2012, has set the aside the order passed by the learned Single Judge and remitted the case for fresh consideration.

For the reasons assigned by this Court in the above-stated case, we allow this appeal and set aside the order under appeal dated 22.5.2012 and remit the case to the learned Single Judge for afresh decision in accordance with law.

The parties are directed to appear before the learned Single Judge on 22.7.2013.
