At the outset, it is pointed out by learned counsel for the petitioners that though the last line of the order dated 20.9.2011 (Annexure P-11) passed by the Revisional Authority clearly says that 5% of the amount “deposited” by the petitioners was directed to be forfeited, yet the respondents have misunderstood it as if 5% of the total sale consideration has been permitted to be forfeited.

Since there appears to be some ambiguity in the order and as prayed for, the instant writ petition is dismissed as withdrawn at this stage with liberty to the petitioners to move an application before the

Revisional Authority for the clarification of its order dated 20.9.2011 (Annexure P-11). The Revisional Authority is directed to entertain the application on merits and pass an appropriate order in accordance with law, within a period of three months from the date of receipt of certified copy of this order.
