The petitioner has been allotted retail outlet dealership by the Hindustan Petroleum Corporation Limitedrespondent Nos.3 & 4 vide letter of intent dated 27.03.2008 at Ballabgarh City, District Faridabad. The petitioner is said to have obtained No Objection Certificate from the Deputy Commissioner, Faridabad as well as various agencies and those have been accorded by all concerned including the State Pollution Control Board as well as the Municipal Corporation. The petitioner thereafter applied to the Director General, Town and Country Planning, Haryana, through the District Down Planner, for permission to Change of Land Use (for short, CLU), to set up the retail outlet. The application was submitted on 19.04.2011 alongwith the requisite fee. Her application though was initially rejected but on an appeal, it was disposed of by the State Government on the basis of a Division Bench decision of this Court holding that since the provisions of the Scheduled Roads and Controlled Area Restriction of Unregulated Development Act do not apply to the area in question as it is in the municipal limits, the petitioner may approach the appropriate authority. The petitioner thereafter is said to have applied to the Commissioner, Municipal Corporation on 17.07.2013 for the grant of CLU permission, but no decision has been taken thereupon so far.
