Petitioners are residents of village Lalheri Khurd, Tehsil Ganaur, District Sonepat. The only direction they have sought in this writ petition is that the respondents be restrained from dismantling Road No.247 bearing Hadbast No.242 Mark A to A1 in the site plan Annexure P-3, which allegedly connects several villages with the town. It is stated by their learned counsel that the land underneath the subject road has not been acquired, yet the respondents are determined to dismantle the road. The petitioners in this regard are said to have given a complaint-cum-application dated 'Nil' (Annexure P-6).

Having heard learned counsel for the petitioners, it appears to us that the writ petition raises disputed questions of facts and is a remodulated civil suit seeking injunction. The site plan on record indicates that a better widened road has been provided for connecting all the villages with the town.

In any case, the nature of relief sought for by the petitioners is purely an administrative discretion for which they are said to have approached the authorities. We, therefore, dispose of this writ petition, without expressing any views on merits, with a direction to respondents No.2 to 6 that if any application/complaint/representation has been received from the petitioners, the same may be considered and disposed of in accordance with law.
