This writ petition has been filed with a prayer that directions be issued to respondent No.2 to hear and pass an order on an application filed by the petitioner seeking interim injunction. It is stated by the petitioner that against an order dated 19.7.2012, the petitioner filed an appeal which was taken up on 31.3.2013. Despite prayer made, no order was passed on application filed by the petitioner seeking interim stay of the execution proceedings. Thereafter, the case was adjourned for seven dates, however, no action was taken despite repeated requests made.
Be that as it may, it is stated at bar that now appeal is fixed for 16.8.2013 before respondent No.2. Taking note of the facts and circumstances of this case, we dispose of this writ petition issuing directions to respondent No.2 to take up application filed by the
