Mohinderpal & Ors. Vs State of Punjab & Ors.

The petitioners are working as Head Teachers in the Education Department, Government of Punjab. They seek a mandamus to direct the respondents to regularize their services w.e.f. 1.10.1980 in terms of the Policy/Instructions dated 28.10.1980 or at the most from 26.10.1982 when their juniors were made regular. It may be noticed that the services of the petitioners were regularized w.e.f. 13.12.1989. In this regard, the petitioners are said to have served the respondents with a legal notice dated 19.10.2012 (Annexure P-4) but without any response thereto so far.

Having heard learned counsel for the petitioners and considering the nature of relief sought in this writ petition, however, without expressing any views on the petitioners entitlement, I deem it appropriate to dispose of this writ petition with a direction to

respondent Nos.1 & 2 to take cognizance of the aforesaid legal notice served on behalf of the petitioners and dispose of their pending claim by passing a speaking order as early as possible but not later than six months from the date of receiving a certified copy of this order.
