Petitioners-Lovejit Singh son of Tejinder Singh, Lakhwinder Singh son of Gurnam Singh and Swaran Singh son of Ujjagar Singh, have preferred the instant petition for the grant of regular bail in a case registered against them along with their other co-accused, vide FIR No.39 dated 20.05.2013, on accusation of having committed the offences punishable under Sections 307, 323, 324, 326 and 148 read with Section 149 IPC, by the police of Police Station Verowal, District Tarn Taran, invoking the provisions of Section 439 Cr.P.C.

Notice of the petition was issued to the State.

After hearing the learned counsel for the parties, going through the record with their valuable help and after deep consideration of the entire matter, to my mind, the present petition for regular bail deserves to be accepted in this context.

What cannot possibly be disputed here is that only ' lalkara' is attributed to Swaran Singh (petitioner No.3). Whereas simple injuries with ' danda' are attributed to Lovejit Singh and Lakhwinder Singh (petitioner Nos.1 and 2) by the prosecution. The main injury, subject matter of offence punishable under Section 307 IPC, was attributed to main accused Jagtar Singh (non-petitioner).

Moreover, the petitioners were arrested on 22/24.05.2013. Since then they are in judicial custody and no useful purpose would be served in further detaining them in jail. It is stated at the bar by learned counsel that the petitioners are not involved in any other criminal case. It is a case of version and cross version, which of the party was the aggressor, would be a moot point to be decided during the course of trial by the trial Court. The conclusion of trial will naturally take a long time.

In the light of aforesaid reasons, taking into consideration the totality of facts and circumstances, emanating from the record, as discussed here-in-above and without commenting further anything on merits, lest it may prejudice the case of either side during the course of trial, the instant petition for regular bail is hereby accepted. The petitioners are ordered to be released on regular bail on their furnishing adequate bail bonds and surety bonds to the satisfaction of the trial Court.
