“Learned counsel, inter alia, contended that simple marriage of the petitioner was solemnized with the complainant Gagandeep Kaur on 18.10.1999. The petitioner is a physical handicapped and his leg was amputated on account of road accident. The complainant could not reconcile and started quarreling with him. She started putting pressure on the petitioner to transfer his residential house in her name. The argument is that the complainant has earlier filed a false complaint with regard to demand of dowry, against the petitioner and a criminal case was registered against him, vide FIR No.164 dated 29.04.2004(Annexure P-1), on accusation of having committed an offence under Section 498-A IPC, by the police of Police Station Sector 39, Chandigarh. The petitioner was arrested, interrogated and was released on bail. Subsequently, the allegations were found to be false and case was sent for cancellation by Inspector General of Police, U.T., Chandigarh, vide report dated 01.09.2005(Annexure P-2). Now the complainant has again moved similar false complaint with the same allegations and to revive the earlier FIR (Annexure P-1). The argument further proceeds that now fresh criminal case was illegally registered against the petitioner, by the police at the instance of complainant, vide FIR No.94 dated 05.03.2013(Annexure P-6), in order to wreak vengeance.
