This is a petition for anticipatory bail filed in case bearing FIR No. 247 dated 29.09.2009, under Sections 302, 323, 149 IPC, registered at Police Station Sadar Fazilka, District Ferozepur.

Learned counsel has argued that FIR was earlier lodged under Section 302 IPC and three persons were named. The other four co-accused were challaned under Section 304 Part II IPC and in an inquiry the police found the petitioner to be innocent. He has however, also accepted the fact that the petitioner was declared a proclaimed offender. In the circumstances he states that the petitioner does not wish to press this petition on merits and will surrender before the trial Court and move an application for regular

bail. In the circumstances he prays that a direction be issued to the learned trial court to decide the said application sympathetically and expeditiously.

I find this to be a fair request.

Resultantly this petition is dismissed. However, a direction is issued to the trial court that in case the petitioner moves an application for bail before it on or before 15.04.2013 and the assertions made above are found to be correct, the trial court shall decide the same expeditiously and sympathetically, within a period of one week from the date of receipt of a certified copy of this order.
