The petitioner seeks grant of anticipatory bail in case FIR No.221, dated 14.12.2002, registered under Sections 323, 324, 326,452, 459, 506, 148, 149 of the IPC, at Police Station City Khanna, Police District Khanna, District Ludhiana.

Counsel for the petitioner has argued that actually the matter was compromised and consequently, the petitioner was under the bona fide mistaken impression that he need not to appear. He has further argued that co-accused has been acquitted by order dated 29.9.2009. Prayer for anticipatory bail has been rejected by the trial Court on the ground that the petitioner has remained absent for about seven years and even went abroad without seeking prior permission of the Court. states that he does not press this petition on merits and prays that the petitioner will surrender before the trial Court and a direction be issued to the trial Court to decide his application for regular bail expeditiously within any fixed time frame.

I find this to be a fair request. Consequently this petition is dismissed. In case the petitioner surrenders before the trial Court on 10.4.2013 and moves an application for regular bail, the trial Court shall decide the same within two days, sympathetically if the above facts are found to be true.
