Defendant is in revision aggrieved against the order dated 16.10.2013 passed by the learned Civil Judge (Junior Division) Phagwara whereby his application for assessing the age of the “ink” with regard to the signatures of the defendant on the Pronote and Receipt from an Expert has been dismissed.
It is apparent that the respondent/plaintiff had filed a suit for recovery of Rs.95,200/- based on a Pronote and Receipt dated 3.8.2009 and the petitioner/defendant has denied his signatures on the same by claiming that his signatures were obtained as a witness on the said Pronote and Receipt in good faith in the year 2003. trial Court has, by referring to a judgment passed by Hon'ble Madras High Court has held that there is no scientific method available for determining the age of the “ink”. In the opinion of this Court said view is correct and even otherwise the stand in the written statement is that the defendant has affixed his signatures as a witness and not as a borrower and therefore, said question even otherwise would become academic.
