The petitioners have invoked the provisions of Article 227 of the Constitution of India for setting aside the order dated 3.8.2012 passed by the trial court.
Learned counsel for the petitioners has submitted that except the defendant, none has appeared to prove the plea of fraud and misrepresentation. Therefore, in these circumstances the plaintiff, who has already appeared in the witness box, could not be permitted again to lead the evidence on that ground.
No merits.
Dismissed.
