Pritpal Singh and Anr. Vs Surinder Kumar Aggarwal and Anr.

The tenants are in revision assailing the order dated 12.7.2013(P3) passed by the learned Rent Controller, Jalandhar whereby provisional rent has been assessed @ Rs.35,000/- per month payable w.e.f. 17.7.2011.

Learned counsel for the tenant has argued that while assessing the provisional rent the learned Rent Controller has not taken into account the extent of alleged damage to the demised premises caused by the landlord and thus, assessed arrears are liable to be reduced.

is wholly devoid of any merit and is liable to be rejected.

The relationship of the landlord and tenants is not denied. The rate of rent is also not disputed. It is also not in dispute that the extent of damage requires leading of evidence and evaluation of the same. It is also not in dispute that at this stage the question being raised is not required to be considered.

In view of the same the impugned order does not warrant interference by this Court in exercise of revisional jurisdiction of this court.

Accordingly, the present revision petition is dismissed with costs of Rs.10,000/- (Rupees ten thousand only) to be deposited with District Legal Service Authority, Jalandhar.
