Defendant no.2 in the present revision petition is challenging the order dated 16.8.2013(P8) passed by Civil Judge (Junior Division)Karnal whereby his application for setting aside ex parte order dated 1.12.2011 (P3) has been dismissed.
Respondent bank filed a suit for recovery on 25.3.2011 for recovery of a sum of Rs.2,66,069/- alongwith interest @ 13.25% p.a., against the petitioner Gurmeet Singh Samran/ defendant no.2 alongwith his son Gagan Samran/ defendant no.1 and his father Amrik Singh/ defendant no.3 for recovery of education loan taken by the duo of father and son/defendant no.2 and defendant no.1 for which grandfather/defendant no.3 was the guarantor. three generations were stated to be served whereas due to non-joining of the proceedings defendants 1 and 2 were proceeded ex parte whereas defendant no. 3 filed his written statement as far as back on 1.12.2011. When the case was at the stage of defence evidence, the petitioner/defendant no.2 filed an application for setting aside the ex parte order which has been dismissed vide impugned order while permitting him to join the proceedings from that stage.
At the time of arguments, learned counsel prays for permission to withdraw the present revision petition.
Dismissed as withdrawn.
