I requested Mr. Sanjiv Bansal, Advocate awaiting his matter to assist this Court as amicus curiae in reconciling the accounts between the petitioner and the Bank represented by Ms. Jyoti Sareen and Mr. Prashar respectively. I am indeed thankful to him that he settled the hotly contested differences between both the parties with his persuasion and both the parties readily agreed that the petitioner will now pay a sum of Rs.1,03,432/- to the respondent-Bank. This would settle all the disputes between the parties.

Ms. Jyoti Sareen, at this stage, submits that there is an expense of Rs.11,000/- towards legal fee incurred by her client which has not been made part of the award and she submits that it should be just and appropriate if this amount is deducted from the amount of Rs.1,03,432/-.

There seems to be no serious dispute of adjusting this amount as it has been forced on the petitioner and its acceptance to adjustment would be a small step towards abiding peace between the parties. I am also informed that an amount of Rs.25,000/- as share money deserves to be adjusted towards the total amount payable. Consequently, the final amount that emerges for payment by Ms. Jyoti Sareen's clients to the respondent-Bank is Rs.67,432/-. I, accordingly, direct that Ms. Jyoti Sareen's clients would now make payment within a fortnight.

On payment being received by the bank within a fortnight, the property of the petitioner shall be released and the equitable mortgage documents lying with the bank will be made available to the petitioner on credit of Rs.67,432/- in the respondents account which would bring an end to this matter.
