Mr. O.P. Sharma, learned Addl. A.G. Haryana has produced a letter dated 16.12.2011 issued by the Labour Commissioner, Haryana correcting the name of the company from MAC Remedies (P) Ltd. to M/s M.A.C. Laboratory Limited, Kirlo Vidya Vihar, Mumbai through its Director in the order of recovery under Section 33-C of the Industrial Disputes Act, 1947 and the same is taken on the record as mark 'X'.

In view of the above, the writ petition has been rendered infructuous and is disposed of as such. Consequently, the orders Annexures P5 and P7 would no longer relate to the petitioner.

Mr. P.S. Jammu, learned counsel appearing for respondent No.4workman does not appear to be satisfied with the letter dated 16.12.2011

therefore, he would remain at liberty to take recourse to his remedies against the letter,if any.

Learned counsel for the petitioner further submits that by the interim order dated 23.6.2011, he had furnished a bank guarantee of `1,25,000/- with the Registrar of this Court, on the basis of which the recovery proceedings against him were stayed. As a result of the order mark 'X', the bank guarantee would be returned to the petitioner by the Registrar General of this Court.
