compliance with the order dated 16.11.2010, respondent No.2 vide its communication dated 10.12.2010 intimated respondent No.3 that the case of the petitioner-mill had been examined and there was no sham transaction. Despite that, the matter was delayed by respondent No.3 and the petitioner suffered a huge loss. It is also averred that the owner mill M/s Naveen Rice and General Mills had filed CWP No.4231 of 2009 before this court which was disposed of vide order dated 14.10.2009 and consequently, the said mill had also deposited the amount to the satisfaction of respondent No.3 but despite that, the petitioner mill having no concern with any other person has been forced to suffer without any reasons. Since there is no sham transaction as admitted by the respondents (Annexure P.9), no order of allotment has been passed for the year 2010-11 but for the year 2011-12, respondent No.2 vide its order dated 21.10.2011 has made the allotment and asked the FCI to accept the rice after considering that there is no sham transaction. Respondent Nos. 3 to 5 are not allowing the petitioner to dump the rice for the crop year 2011-12 and as a result, the petitioner is suffering huge loss. Hence the petitioner has filed the present writ petition impugning the order dated 17/18.1.2012, Annexure P.12.
