service. The workman not having satisfied the punishing authority with his defence, was fastened with an order of dismissal from service. The petitionerworkman was found to have betrayed the trust reposed in him; that the management had lost confidence in such a worker and on proof of charges the order of punishment was passed. The petitioner was heard before the punishment order was passed. Darshan Lal, Checker was produced as a Management witness. He supported the events of the fateful day. His testimony establishes that misconduct was committed. The petitioner–workman opted not to cross-examine him. The second Management witness Sh. Ramswaroop, Inspector, who was also present at the time of checking, supported the case of the prosecution. He too was not cross-examined by the petitioner-workman. The petitioner in his testimony admitted that tickets worth Rs. 33/- were less with the passengers travelling in the bus but took the defence that the passengers themselves had misplaced the tickets.
