By filing this writ petition a concern has been shown regarding non construction of Ganda Kacha Nallah, Dabua Pali, Nehru Colony, NH3 into Pucca Nallah and also regarding disposal of garbage lying on both sides of the road, open public places and thrown it into open sewerage drain.

After issuance of notice of motion, various directions were issued. On 30.7.2012, it was ordered as under:-

“Requisite information as desired by the Court has not been supplied in the affidavits which have been handed over to us in the Court today. Accordingly, the affidavits are returned to the State counsel and counsel for the Municipal corporation.

It is brought to our notice that on 12.7.2012, when Mr.T.C.Gupta was directed to come present in Court, to give a suggestion as to how door-to-door collection of the garbage can be facilitated in the Municipal Corporations and

Committees, he was not Secretary of the department. This information was not supplied to us on 23.7.2012 when matter was taken up again. Today, it is stated that instead of Mr.T.C.Gupta, Mr.Mohinder Kumar, IAS is the Special Secretary of the department, who is also present in Court. He need not to come present on the next date. After perusing the photographs, we are convinced that the situation at the spot is unbearable. Litter and dirty water is spread over everywhere. Drains are chocked. People may be suffering stink and difficulty in passing from the roads.

Under the circumstances, we direct Mr.Mohinder Kumar to make a visit at the spot, convene a meeting with the Municipal Corporation authorities and suggest ways and means to remedy the situation. The Municipal Commissioner, Faridabad is also directed to file an affidavit as to within how much time the remaining portion of open dirty water street will be covered.

In response thereto, Mr.Sameer Pal Srow, Joint Secretary to Govt. Haryana, Urban Local Bodies Department has filed an affidavit in Court today, wherein it is stated that open drain has been covered and other measures are being taken for proper disposal of sewerage water of the area in dispute. Photographs regarding the work done have also been attached with the affidavit. It is further stated that as per direction issued by this Court, site was visited by the deponent on 7.9.2012. The local population was satisfied with the steps being taken.

We hope and trust that if any work remains to be completed, the authorities will complete the same within next three weeks.

Before parting with the order, we are of the view that the problem in hand is a creation of residents of the area by spreading litter here and there. Counsel for the petitioners is directed to organize a seminar in

the area to make the people aware of, regarding proper disposal of the garbage by suggesting some ways and means regarding collection of garbage from the area in and around the houses.

With above observations the writ petition stands disposed of.
