Ashwani Kumar Saini Vs Union of India and Ors.

The petitioner, who is working in Central Institute for Research on Buffaloes, Sirsa Road, Hisar, has challenged order dated 30.7.2011 (Annexure P-1) before this court.

At the very outset, learned counsel for respondent no. 3 raised a preliminary objection stating that jurisdiction pertaining to the service matters of the employees of Central Institute for Research on Buffaloes, Sirsa Road, Hisar, lies with the Central Administrative Tribunal.

The aforesaid fact is not disputed by learned counsel for the petitioner.

Considering the objection raised by learned counsel for respondent no. 3 and the fact that writ petition is pending in this court after notice of motion, I deem it appropriate to transfer the present petition to the Central Administrative Tribunal, Chandigarh Bench, Chandigarh, for further proceedings. Considering the fact that issue of limitation may arise, it is directed that the original application on behalf of the petitioner shall be treated as filed on the date when the writ petition was filed before this court. If the respondents have any objection of delay, they may be at liberty to raise the same.

A copy of the petition may be kept in this court for record.
