Learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to the petitioner to file a fresh petition challenging the vires of the University Statute whereby Director of Physical Education has not been specifically included in the definition of teacher, though in terms of judgment of Hon'ble Supreme Court in P.S Ramamohana Rao vs
A.P. Agricultural University and another, JT 1997 (7) SC 173, the
Director, Physical Education also discharges the duty of a teacher.
Ordered accordingly.
