Sukhdev Singh Vs State of Punjab and Ors.

The petitioner has approached this Court for issuance of direction to the respondents for grant of promotion from the date his juniors were promoted with all consequential benefits. The promotion was denied to the petitioner at the relevant time as he was facing trial in a case under the Prevention of Corruption Act.

At the very outset, learned counsel for the respondents has raised preliminary objection regarding maintainability of the writ petition against the Punjab State Cooperative Agricultural Development Bank Limited. In support of his arguments, learned counsel placed reliance upon a judgment of this Court in CWP No.14990 of 2007 (O&M) decided on 17.09.2009, titled as Meenakshi Vs. State of Punjab and others and a Division Bench judgment of this Court in LPA No.2252 of 2011 (O&M) decided on 18.04.2012,

titled as Som Nath and others Vs. The Deputy Registrar Cooperative Societies, Hoshiarpur and others .

Considering the objection raised by learned counsel for the respondents, learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to avail of his appropriate remedy in accordance with law.
