This petition has been filed with a prayer that the orders Annexures P-20 and P-21 be quashed and further, a direction be issued to the respondents to issue a passport to the petitioner.

The petitioner who is a passport holder, was issued the first passport in the year 1981 under the name of Manjeet Singh Rattu and his date of birth was recorded as 16.9.1962. His passport was valid upto 1986 and was renewed subsequent thereto. It is his case that he lost the passport and was issued another passport in lieu of the original passport. The petitioner thereafter visited Islamabad and Lahore in Pakistan and other countries such as U.K. etc. He

married one Sajida Sultana and under her influence, he converted himself to Islam and changed his name from Manjeet Singh Rattu to Mumtaz Sharif and got a new passport on 26.3.1993. His wife Sajida Sultana who is a Pakistani National, left the petitioner in the year 1994.

It is now the case of the petitioner that because of the opposition from some journalists in India and the family of his in-laws in Pakistan, he is facing a problem and his passport which has expired, is not being renewed and rather, the orders Annexures P-20 and P-21 have been passed, whereas the passport of the petitioner has been impounded under Section 10(3)(B) of the Passport Act, 1967 on account of giving wrong information.

Reply has been filed by the respondents who have justified the impounding of the passport of the petitioner as it has been found that the petitioner obtained more than one passport without disclosing the existence of the previous passport and that wrong particulars such as date of birth etc. were given by him. Explanation was sought from the petitioner which led to the conclusion that the petitioner has been deliberately giving false information.

From the above, it is clear that the petitioner has deliberately given false information. There is no denial to these facts as the petitioner has not filed any replication.

In view of this when the respondents are satisfied that the particulars submitted by the petitioner are not authentic and rather he has obtained the passport by furnishing false information, I am of the opinion that such directions as have been prayed for by the petitioner, do not merit acceptance.
