The dispute in the present writ petition relates to appointment of Chowkidar of Village Daun Khurd. The petitioner was appointed as Chowkidar by the Sub-Divisional Magistrate, Patiala. However, the Collector accepted the appeal filed by respondent No.3 and set-aside the appointment of the petitioner and has appointed respondent No.3 as Chowkidar.
The notice in this case was issued and the operation of the impugned order was stayed on 21.7.2011. No reply has been filed. Counsel for respondent No.3 had stated that he would argue the matter without filing any reply. Today, counsel for the petitioner submits that there is a scope of compromise and accordingly pleads for a short adjournment. This request is declined. However, the

parties would be at liberty to seek an amicable settlement of the problem and would be at liberty to reach any compromise if otherwise agreed between the parties.
Counsel for the petitioner seeks permission to withdraw this writ petition as not pressed at this stage with liberty to revive the same in case the compromise between the parties does not materialise. However, counsel for respondent No.3 has pleaded no instructions in this regard.
The petition is dismissed as not pressed at this stage with liberty to revive the petition in case there is no compromise reached between the parties.
