This writ petition has been filed seeking issuance of directions to respondents No. 1 to 10 for removal of un-authorised occupants from the Gram Panchayat land measuring 7 acres which was kept reserved for Green Belt in the year 1950. To say so, reference has been made to a site plan placed on record and the representations made by the Gram Panchayat to the higher authorities for taking necessary action and letters written by SDM to his superiors for the said purpose.

The demarcation report has not been placed on record to show encroachment by the villagers. Further, there is nothing on record, in form of Revenue documents, to show that in fact 7 acres of land was reserved for common purposes of the village and it belongs to the Gram Panchayat.

Under such circumstances, we dispose of this writ petition by issuing directions to the Block Development and Panchayat Officer, Kharar to search the revenue documents to find out whether the land in dispute is the public land and belongs to the Gram Panchayat or any other public authority. If the land is found belonging to the Gram Panchayat, demarcation of the same be got done and action be initiated for eviction of the encroachers under the provisions of Punjab Village Common Lands (Regulation) Act, 1961.
