By making reference to a letter dated 9.12.2010 (Annexure P2) written by the General Manager (T) and Project Director, for widening of service road in the congested areas falling on National Highway-1, to the higher officers of the National Highway Authority of India (hereinafter referred to as “the NHAI”), this writ petition has been filed for directions to the NHAI to widen the service roads along side the national highway within the cities through which NH-1 passes.

Perusal of that letter reveals that width of the service lanes is 5 to 8 meters, whereas it is proposed to be made more than 10 meters because on completion of the highway, to reach the underpasses the present service lanes will not be able to manage the traffic.

At the time of arguments, it has been brought to notice of the Court that representation dated 22.6.2012 (Annexure P3) sent by the

petitioner to the Ministry for Road, Transport and Highways, Union of India, is still pending. Otherwise also it is a technical matter to be considered by the experts and cannot be gone into by this Court while exercising powers under Article 226 of the Constitution of India.

Under the circumstances, we dispose of this writ petition by issuing directions to respondent No.4 to take into consideration the representation filed by the petitioner and take appropriate decision thereon. The petitioner is also directed to send a copy of his representation to respondent No.4 forthwith, who shall get the same examined from the experts, keeping in view the facts and figures given by the General Manager (T) and Project Director in his letter dated 9.12.2010 (Annexure P2). The needful shall be done within six months from the date of receipt of a copy of this order and a copy of representation as well. The decision so taken on the representation be communicated to the petitioner.
