The petitioner is a society and the present writ petition has been filed seeking issuance of writ of certiorari to quash allotment of plots made by respondents No.4 and 5, allegedly in connivance with respondent No.3, in violation of the Mahatma Gandhi Basti Yojna Scheme to the so called non-deserving candidates.
Upon notice, separate replies have been filed by the respondents. In reply filed by respondents No.l to 3, it is stated that after enquiry it was found that plots were rightly allotted to the eligible candidates. To say so reference has been made to an enquiry conducted by Block Development and Panchayat Officer, Sampla, report of which was

sent to the Deputy Commissioner, Rohtak on 16.3.2012. Perusal of the said document (Annexure R-II) indicates that the names of the deserving candidates were approved by the Village Level committee as per Government Instructions, and after proper verification their names were sent for allotment of the plots. The petitioner is a registered Society and the Scheme is for allotment of plots of 100 Sq. Yards to the families living below the poverty line and to eligible persons of S.C. and B.C. Categories. The petitioner being a society cannot plead that the cause espoused in the present writ petition is in the public interest especially when a scheme of Government floated for the benefit of poor strata of society is being challenged. Registered societies are supposed to work for the benefit of poor persons and not formed to fight against the benefits being given to them by particular Schemes of the Government.
Accordingly, the present writ petition is dismissed.
