Learned counsel for the applicant-Kulvir Singh submits that Kulvir Singh being maternal grand son of the deceased Jang Singh may not be a 'victim' so as to be entitled to file an application for grant of leave to appeal in terms of proviso to Section 372 of the Code of Criminal Procedure. He, therefore, prays that he may be allowed to withdraw the present criminal miscellaneous application seeking grant of leave to file an appeal so as to file a fresh one through a legal representative of deceased Jang Singh.
The criminal miscellaneous application is dismissed as
withdrawn.
