Petitioner-Tek Chand has preferred the instant petition for grant of anticipatory bail in a case registered against her along with other co-accused, by means of FIR No.43 dated 12.2.2005, for the commission of offences punishable under Sections 342, 365, 166, 323, 506, 34 and 120-B IPC, by the police of Police Station F.P.Jhirka, District Gurgaon, invoking the provisions of Section 438 Cr.P.C.

“Learned counsel, inter alia , contended that the controversy involved in the instant petition is identical to the one raised in Crl. Misc. No. M-15670 of 2009 titled Janki Parsad and another vs. State

of Haryana and another , which stands already decided by a Co-ordinate Bench of this Court (Rajan Gupta, J.), vide order dated 27.10.2009 (Annexure P-4).

Notice of motion be issued to the respondents, returnable for 10.09.2012.

The interim order is granted in the same terms and conditions, as contained in order dated 27.10.2009 (Annexure P-4).”

The petitioner was directed to surrender before the trial

court within a week of receipt of certified copy of the order dated 29.8.2012 and apply for regular bail but the petitioner had neither complied with the terms and conditions of the previous order nor any cogent explanation is forthcoming in this regard.

Therefore, the present petition is dismissed.
