Prayer in this petition is for grant of regular bail to Charanjit Singh-petitioner who has been booked for having committed the offences punishable under Sections 138 of the Negotiable Instrument Act and 420, IPC.

Learned counsel for the petitioner contends that the petitioner did appear before the learned court below after his summoning and was granted bail. Due to unavoidable circumstances, he could not appear before the learned trial court on 27.10.2010, therefore, his bail bonds were forfeited and non bailable warrants were issued for securing his presence and ultimately, he was declared proclaimed offender on 22.10.2011. He further submits that the petitioner appeared before the learned trial court on 17.04.2012 and since then, he is behind the bars. He further submits that the impugned cheque was of Rs.40,000/- only.

The petitioner is behind the bars for the last more than 05 months and 15 days. The cheque amount was of Rs.40,000/only. The trial would take sufficient time to conclude.

Without discussing much on the merits of the case, the present petition is allowed. Petitioner-Charanjit Singh s/o Mohinder Singh, R/o Street No.4, Satguru Nagar, Near Jain Da Theka, Shimlapuri, District Ludhiana, is ordered to be released on bail during the pendency of the trial subject to his furnishing bonds in the sum of Rs.40,000/- with two sureties in the like amount to the satisfaction of learned trial court.
