This is a petition filed under Section 439 of the Code of Criminal Procedure for grant of concession of regular bail to the petitioners in case FIR No.34 dated 6.5.2011 registered under Sections 302/120-B read with Sections 148/149 IPC, at Police Station Chabbewal, District Hoshiarpur.
Learned State counsel states that the complainant has not been examined.
Learned counsel for the petitioners wants to withdraw the present petition with liberty to file fresh one after the examination of the complainant. Learned counsel for the petitioners has pointed out that intentionally evidence is not being led by the prosecution. He further states that in the statement of Harjinder Singh petitioners have not been attributed any specific injury and no specific role has been attributed to them. In these circumstances it is necessary that the trial should be concluded as early as possible.
Dismissed as withdrawn with the aforesaid liberty. However, learned trial Court is directed to conclude the trial as early as possible preferably within a period of six months from today.
