Learned counsel for the petitioner and the State have submitted that only the investigating officer remains to be examined and the case is fixed for his evidence on 07.09.2012.
In the circumstances, learned counsel for the petitioner submits that he may be allowed to withdraw the criminal miscellaneous petition at this stage. However, the learned trial Court may be directed to conclude the trial as expeditiously as possible.

However, the learned trial Court shall make every effort and endeavour to conclude the trial as expeditiously as possible and preferably within a month after 07.09.2012 which is the fixed date before the trial Court.
