By filing this petition under Section 438 of the Code of Criminal Procedure, Damodar and Gyan-petitioners seek anticipatory bail in case bearing First Information Report No.63 dated February 10, 2010 under Sections 363,366 and 506 of the Indian Penal Code, Police Station Model Town, Panipat.
On September 6, 2012, this Court passed the following
order: -
“ XXXXX XXXXXX
Meanwhile, in the event of arrest, the petitioners (Damodar & Gyan) shall be released on bail by Arresting Officer to his satisfaction. They shall abide by the conditions laid down under Section 438 (2) (i) (ii) and (iii) Cr.P.C.”
Learned State counsel has stated that pursuant to the aforesaid order, petitioners have joined the investigation and are not required for custodial interrogation.
In view of above, order dated September 6, 2012 is made
absolute.
