The petitioner seeks bail pending trial, by way of instant petition under Section 439 Cr.P.C., in the case arising out of FIR No. 33 dated 10.4.2012, under Sections 323, 324, 34 IPC, registered at Police Station Sadar Mansa, District Mansa and later on added Sections 307, 326, 325 IPC.
Notice of motion was issued.
Learned counsel for the State submits that charge has already been framed in the present case and trial is now fixed for 12.9.2012 for prosecution evidence.
Faced with the above, learned counsel for the petitioner submits that he does not intend to press this petition. He further submits that let the present petition be dismissed as withdrawn, at this stage.
