The instant petition has been filed by the petitioner under Section 438 Cr.P.C., invoking the inherent jurisdiction of this Court, seeking pre-arrest bail in the case arising out of FIR No.63 dated 02.05.2010 under Section 420/506/120-B IPC registered at Police Station Sultanwind, Amritsar City.
Notice of motion was issued vide order dated 13.07.2012 and
interim protection was granted to the petitioner.
Learned State counsel submits that the accused, as a matter of fact, had already been declared proclaimed offender by the learned trial Court
vide order dated 14.12.2011. However, this fact could not be brought to the notice of the learned Additional Sessions Judge, Amritsar while passing the impugned order, declining the anticipatory bail to the accused.
Faced with the above said situation, learned counsel for the

petitioner submits that he does not intend to press this petition and seeks permission of the Court to withdraw the present petition with liberty to the petitioner to surrender before the learned trial Court. However, learned counsel for the petitioner submits that the learned trial court may be directed to decide the application for bail of the petitioner, dispassionately and expeditiously.
In view of the above statement made by learned counsel for the petitioner and without prejudice to the rights of the parties, the instant petition is ordered to be dismissed as withdrawn, with liberty to the petitioner to surrender before the learned trial Court within two weeks from today.
Learned trial Court is directed to consider the application for bail
moved on behalf of the petitioner, in case she surrenders within two weeks from today, dispassionately and expeditiously, passing appropriate order thereon, in accordance with law.
With the observations made, the present petition stands disposed
of.
