This petition under Section 482 of the Code of Criminal Procedure has been filed for quashing the criminal complaint No.271-A dated 17.10.2008, titled as “Gurdev Singh vs. Tarlochan Singh and others” pending in the Court of learned Judicial Magistrate, 1^st Class, Mohali and all consequential proceedings arising therefrom, on the ground of compromise Annexure P-5.

The grounds pleaded are that the parties have compromised the matter with the intervention of the respectables, therefore, no useful purpose would be served if the proceedings are allowed to continue. Both the parties have executed a compromise deed dated 25.4.2012 Annexure P-5, wherein

they have stated that the matter has been amicably settled between them. The complainant has make a statement before this Court, wherein he has stated that he does not want to pursue the complaint in question and he has no objection of the said complaint is quashed.

In view of the law laid down by the Full Bench of this Court in re: Kulwinder Singh and others versus State of Punjab and another 2007(3) Recent Criminal Reports (Crl.) 1052, the Court is competent to quash the proceedings on the basis of compromise. Sequelly, this petition is accepted and criminal complaint No.271-A dated 17.10.2008, titled as “Gurdev Singh vs. Tarlochan Singh and others” pending in the Court of learned Judicial Magistrate, 1^st Class, Mohali and all consequential proceedings arising therefrom are hereby quashed qua the petitioners.
