Challenge in the present petition is to the orders passed by the learned courts below, whereby in the suit filed by the petitioner for permanent injunction, prayer for restraining the respondents from releasing electric connections on the service line erected at the cost of the petitioner, was declined.

Learned counsel for the petitioner submitted that the petitioner got an electricity line erected for release of connection for his tubewell under self-financing scheme. The entire cost was borne by him. Now without paying any money to the petitioner, Dakshini Haryana Bijli Vitran Nigam Ltd. (for short, 'the Nigam') is releasing connection to another consumer on the way, which is illegal.

After hearing learned counsel for the petitioner, I do not find any merit in the submissions made. The petitioner-plaintiff has not placed on record any material before the court to show that there is any bar on the Nigam to release connection to any consumer on the way, in case the line is erected at the cost of one of the consumers under self-financing scheme. my opinion, no interference is called for with the impugned orders. Accordingly, the present petition is dismissed.
