Gurmeet Kaur Vs Dharam Dutt Ternach and Others

The short grievance of the petitioner in this contempt petition is that though allotment of the subject land in her favour has been upheld by this Court vide order dated 26.11.2010 (Annexure P-6), yet the authorities are not delivering possession of the land. In this regard, the petitioner has approached the authorities vide representation dated 24.5.2011 (Annexure P-8) also.

Having heard learned counsel for the petitioner though I do not find any ground to initiate contempt proceedings as no direction issued by this Court can be said to have been violated or breached, however, in order to avoid unnecessary litigation, this contempt petition is disposed of with a clarificatory direction to respondent Nos.1 & 3 to take appropriate decision on the petitioner's representation in accordance with law/rules as early as possible and preferably within a period of three months from the date of receiving a certified copy of this order.
