The landowner has filed the present appeal against the award of the learned court below passed under Section 18 of the Land Acquisition Act, 1894 (for short, 'the Act') seeking enhancement of compensation for the acquired land.
Briefly, the facts are that land situated in village Dhanas, Union Territory Chandigarh was sought to be acquired by Chandigarh Administration vide notification dated 4.7.1980 issued under Section 4 of the Act, for rehabilitation of 500 families in Dhanas area in Chandigarh. Notification under Section 6 of the Act was issued on 22.9.1980. The Land Acquisition Collector (for short, 'the Collector') assessed the market value of the acquired land @ 35,000/- per acre. Dissatisfied with the award of the Collector, the landowner filed objections. On reference under Section 18 of the Act, the learned court below determined the market value of the acquired land @ 60,000/- per acre. It is this award which is impugned in the present appeal.
The case was called twice. However, no one has appeared on behalf of the appellant in support of the claim made in the appeal. It seems that the appellant is not interested in pursing his appeal. Accordingly, the same is dismissed in default.
