On the last date of hearing following order was passed in this
case:-
“Learned State counsel submits that the prayer made in the petition has been rendered infructuous by now.
Learned counsel for the petitioner, however, prays for one last opportunity to seek instructions and apprise the court whether any cause of action survives in this case.
To come up on 14.07.2011. ”
It is evident that counsel for the petitioner had sought one last opportunity to apprise the court whether any cause of action survives in this petition. Today no one has put in appearance on behalf of the petitioner.
Learned State counsel asserts that petition has infact been rendered infructuous due to lapse of time.
In view of the fact that there is no representation on behalf of the petitioner, the petition is dismissed for want of prosecution.
