Learned counsel for the petitioner undertakes that the entire outstanding of the bank as mentioned in Annexure R-2 with future interest upto the date of payment shall be paid on or before 29.12.2012. Learned counsel for the petitioner further undertakes that a sum of Rs.5 lacs shall be deposited on or before 7.1.2012. On deposit of Rs. 5 lacs, the bank shall communicate the balance due as on 29.12.2012 to the petitioner to enable him to clear the entire outstanding. In the event, the petitioner fails to make deposit of the amount as undertaken before this Court, the respondent shall be entitled to seek its remedy in accordance with law.
The writ petition is disposed of accordingly.
