Mr. Gupta, learned counsel for respondents states that the competent authority of the Food Corporation of India has decided to refund the security amount after affecting recovery of Rs. 66.26 lakh on account of retrospective application of the reduced rates on Cheeka to Dungarpur route. Copy of the said communication to this effect has been placed on record.
Mr. Gupta further states that the amount of refund of the security amount after the deductions shall be released within a period of one month.
In view of the said communication, learned counsel for the petitioner wishes to withdraw the present petition with liberty to challenge the alleged recoveries in the appropriate proceedings according to law.
Dismissed as withdrawn with liberty aforesaid.
