The petitioner seeks a mandamus for her appointment on the post of Hindi Mistress on the plea that some of the advertised posts have remained unfilled due to non-joining of the selected candidates.
It is averred that the petitioner is the next candidate in order of merit. The petitioner's claim was earlier turned down on the plea that all the posts have been filled up, however, the petitioner has now received an information under the Right to Information Act, 2005 (Annexure P-10) through her husband to the effect that some of the posts are still lying unfilled due to non-joining of the selected candidates. The petitioner has lodged the aforesaid claim vide representations dated 18.11.2010, 6.6.2011

and 4.7.2011 (Annexures P-11 to P-13) also.
Having heard learned counsel for the petitioner and keeping view of the factual position stated above, however, without expressing any views on the merits of the petitioner's claim, I deem it appropriate to dispose of this writ petition with a direction to the respondents to consider the aforementioned claim of the petitioner as contained in the representations and dispose of the same by passing a speaking order within a period of four months from the date of receiving a certified copy of this order.
