By this order I propose to decide two writ petitions i.e. CWP No. 11405 and 18545 of 2010, as the claim sought by the petitioners in these writ petitions are identical, as they are claiming stepping up of their pay to the stage of their junior namely Sh. Sarvmitter Sharma,

said benefit are still pending with the High Court. After detailed consideration by various Committees, it has been brought to the notice of the Court that a final decision and the parameters under which the claim of the petitioners and other similarly situated employees of the High Court has been finalized. Both the counsel for the High Court on instructions states that the representations of the petitioners would be considered and a decision thereon would be taken before 15.7.2011 and orders so passed shall be conveyed to the petitioners forthwith.

This stand of the High Court appears to be reasonable to some extent. However, counsel for the petitioners states that in the cases of similarly placed employees Hon'ble Single Bench of this Court had passed an order granting the said benefit, which has been upheld by a Division Bench of this Court in LPA No. 1781 of 2010 titled 'Punjab & Haryana High Court vs. Rajan Nanda & Ors.' decided on 16.5.2011 and the said judgment be also taken into consideration.

In view of what have been recorded above, the present writ petitions are disposed of with directions to the Registrar General, Punjab & Haryana High Court to consider the representations of the petitioners and pass a speaking order within the time as stated by the counsel for the High Court. The judgment passed by this Court in LPA No. 1781 of 2010 titled 'Punjab & Haryana High Court vs. Rajan Nanda & Ors.' decided on 16.5.2011 shall also be taken into consideration.
