This is a petition for regular bail filed in case bearing FIR No. 32 dated 28.07.2010, under Sections 323, 324, 326, 307, 427, 34 IPC registered at Police Station Begowal, District Kapurthala.
Learned counsel for the petitioner states that the petitioner has now been in custody for the last six months and the allegation against him cannot attract Section 307 IPC.
Learned DAG, on instructions from ASI Mukhtiar Singh, states that the charge has been framed against the petitioner and the matter is now fixed for 01.03.2011 for prosecution evidence. The investigating officer has further undertaken that the entire evidence of the prosecution would be led on or before 30.04.2011.
In the circumstances I am inclined to dismiss this petition with the observation that in case evidence is not led within the month of April, 2011, the trial Court shall enlarge the petitioner on bail to its own satisfaction.
